The Company is a privately owned, independently operated valet parking service and is in no way affiliated with, endorsed by, or associated with OR Tambo International Airport, Airports Company South Africa (ACSA), or any government authority. All references to the airport name are purely for geographic identification purposes.
The Company's storage facility is situated off-site, within approximately 9 km of OR Tambo International Airport. "Parking" includes the stationary storage of the vehicle at the Company's premises and all transit of the vehicle between the airport and the facility.
All images displayed on the Company's website and marketing materials are used for illustration and marketing purposes only and are not necessarily representative of actual facilities or conditions at any given time. All vehicles are stored in a covered, secure parking facility.
A binding service agreement is formed upon the Customer submitting a booking (online, telephonically, or via any electronic means) or upon signing the Booking Document at the time of vehicle drop-off, whichever occurs first. These Terms and Conditions are incorporated by reference into that agreement.
The Company agrees to collect, store, and return the Customer's vehicle at the designated time and location as specified on the Booking Document, at the applicable fee. All services are subject to availability and operational capacity.
By entering into this agreement, the Customer grants the Company a limited power of attorney to drive the vehicle to and from the Company's premises and within the approved perimeter of OR Tambo International Airport for the sole purpose of providing the agreed services. The Company is authorised to allow its nominated drivers and staff to operate the vehicle for this purpose only.
The Customer authorises the Company to drive the vehicle a maximum of 25 km within the perimeter of OR Tambo International Airport for the purposes of collection, storage, and return. No other driving is authorised unless expressly agreed upon in writing. In exceptional circumstances such as alternate delivery destinations, additional mileage charges will apply.
The Company's drivers shall endeavour to comply with all applicable traffic laws. Should a traffic fine be issued whilst the vehicle is in the Company's care, the driver involved shall be personally responsible for payment thereof. Any fines arising from the Customer's own prior driving, expired vehicle licences, or pre-existing infringements remain solely the Customer's responsibility, and the Company reserves the right to recover any resulting costs from the Customer.
The Company will endeavour to deliver vehicles as promptly as possible in accordance with agreed times. However, the Company shall not be held liable for delays caused by circumstances beyond its reasonable control, including traffic, weather, flight delays, or force majeure events. Customers must ensure their contact details are accurate and accessible at all times for communication purposes.
A full inspection of the vehicle's exterior, interior, and contents must be conducted by the Customer and a Company representative at the time of drop-off. Any pre-existing damage, chips, scratches, dents, mechanical faults, or tyre conditions must be noted on the Booking Document and signed by both parties. The Customer is solely responsible for ensuring this inspection is completed accurately before departing.
If the Customer fails to conduct or insist upon a vehicle inspection, or fails to record existing damage on the Booking Document, it shall be conclusively presumed that the vehicle was returned in the same condition as when it was received by the Company. The Company will not be held liable for any damage not recorded at the time of drop-off.
The Company reserves the right to conduct a follow-up inspection of the vehicle once delivered to its premises and to communicate the results to the Customer electronically. The Customer is encouraged to inspect the vehicle thoroughly upon collection and to raise any concerns immediately at the time of return.
The Company shall not be held liable for stone chips, windscreen chips, cracked or damaged rims, hub caps, or tyre damage sustained during normal transit of the vehicle on public roads, as these types of damage are outside the Company's control.
The Customer is required to disclose all valuables left in the vehicle to the Company's driver at the time of drop-off. Such items must be listed on the Booking Document and signed by both parties. It is strongly recommended that all valuables, including cash, cellphones, laptops, tablets, electronic devices, jewellery, and personal documents, be removed from the vehicle before handover.
The Company accepts no liability for the loss of, or damage to, any valuables or personal effects not recorded on the Booking Document at the time of drop-off. The Customer hereby indemnifies the Company against any claims arising from the loss or damage of undisclosed valuables.
The vehicle is parked and handled entirely at the Customer's own risk. The Customer acknowledges that all driving, parking, storage, shuttling, and handling of the vehicle by the Company, its staff, drivers, and agents is carried out at the sole risk of the Customer.
The Company shall under no circumstances be liable for any direct, indirect, consequential, or special loss or damage, including but not limited to damage from fire, theft, accident, flood, riot, hail, windstorm, armed robbery, acts of God or force majeure events, mechanical failure, or loss of income. In the event the Company is found liable despite this clause, the Company's maximum liability shall be limited to R3,000.00 (Three Thousand Rand) in total.
The Customer unconditionally indemnifies and holds harmless the Company, its directors, employees, drivers, and agents from any and all claims, damages, costs, liabilities, and expenses arising directly or indirectly from the use of the Company's services, including claims arising from negligence or gross negligence on the part of the Company or its employees, to the fullest extent permitted by applicable law.
Any claim by the Customer against the Company arising from this agreement shall be limited in value to the total parking tariff paid by the Customer for the relevant booking. All claims must be submitted in writing within 7 (seven) calendar days of collection of the vehicle, failing which the Customer's right to claim shall be permanently forfeited.
It is the Customer's sole responsibility to ensure that the vehicle is comprehensively insured for total loss or damage while in the care, custody, and possession of the Company. The Customer's insurer must be notified that the vehicle will be driven, collected, stored, and returned by the Company and its drivers. The Company carries no insurance obligation on behalf of the Customer.
The Customer shall maintain such insurance as is necessary to cover liability for any loss or damage to the vehicle and shall indemnify and hold harmless the Company against any lawsuits, claims, costs, and expenses of whatsoever nature resulting from or arising in connection with the provision of services under this agreement.
Parking fees are charged in accordance with the Company's published standard tariffs at the time of booking. The Company reserves the right to revise its tariffs at any time without prior notice, provided that changes shall not apply retroactively to confirmed and paid bookings.
Full payment of the agreed parking fee is due and payable upon collection of the vehicle unless alternative payment arrangements have been agreed to in writing. The Company reserves the right to retain the vehicle as a pledge and lien security until full payment is received and cleared. No vehicle shall be released until all outstanding amounts have been settled in full.
If the Customer fails to collect the vehicle by the agreed return date, additional daily storage fees shall accrue at the standard daily rate. The Company shall be entitled to exercise a storage lien over the vehicle. Should the vehicle remain uncollected for more than 20 (twenty) business days after written notification, the Company shall be entitled, with full power of attorney herein granted, to sell the vehicle by public auction or private treaty to recover outstanding costs, accounting to the Customer for any net proceeds thereafter.
No payment shall be deemed valid until it has been fully cleared and received into the Company's bank account. The Customer expressly authorises the Company to debit any card details provided for amounts due and owing in terms of this agreement.
Vehicle collection or delivery between 23:00 and 03:45 will incur a late-night surcharge in addition to the standard parking fee. Surcharge rates: R100 (23:00-00:00), R150 (00:00-01:00), R200 (01:00-02:00), R250 (02:00-03:00), R300 (03:00-03:45). These surcharges are non-negotiable and form part of the total amount payable.
A cancellation fee of R150.00 applies where the Company has already collected the Customer's vehicle and is required to return it due to a flight change, cancellation, or any other reason attributable to the Customer. This fee covers the cost of the additional trip and resources deployed.
The Customer may not raise any claim, dispute, or counter-claim as a reason to defer, withhold, or set off payment of any amounts due to the Company. All amounts must be paid in full, with any disputes addressed separately through the appropriate dispute resolution mechanism.
A complimentary exterior car wash is included with every parking booking as a courtesy service. The Company endeavours to return all vehicles in a clean condition; however, the Company cannot guarantee a pristine state at all times due to weather conditions, road dust, or road surfaces encountered during transit. The complimentary car wash is a value-added courtesy and does not give rise to any separate liability on the part of the Company.
The Customer is strictly prohibited from leaving any illegal goods, substances, contraband, controlled drugs, radioactive materials, flammable or noxious materials, or any items that are dangerous, hazardous, or likely to harbour vermin in the vehicle when it is left in the Company's care. Any action, fine, cost, or liability imposed on the Company or its employees as a result of such items shall be borne entirely by the Customer. The Customer hereby unconditionally indemnifies and holds harmless the Company against all such consequences.
The Company maintains the highest standards of integrity in the care of all vehicles. Should any Customer make an allegation regarding the conduct of the Company's personnel, the Company reserves the right to subject all relevant parties to an independent integrity investigation. The findings of such an investigation shall be treated as conclusive in the Company's internal proceedings.
All aggrieved parties are invited to first contact the Company directly to resolve any issues or disputes arising from this agreement before escalating to any external body or legal proceedings. The Company is committed to resolving all genuine complaints promptly and professionally.
The Customer agrees not to distribute or disseminate any information, allegations, or reviews that are harmful, misleading, or defamatory to the Company without first affording the Company the opportunity to resolve the matter internally. The Company reserves the right to institute remedial legal action against any party who breaches this clause.
This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or in connection with this Agreement shall be determined in accordance with South African law.
The parties consent to the jurisdiction of the Magistrate's Court having jurisdiction over the area in which the Company's premises are situated, in terms of Section 45 of the Magistrate's Court Act No. 32 of 1944, notwithstanding that the value of any claim may exceed the monetary jurisdiction of the Magistrate's Court. The Company retains the right to institute proceedings in any court of competent jurisdiction.
In the event that either party institutes legal proceedings arising from this Agreement, the successful party shall be entitled to recover legal costs on an attorney-and-own-client scale, including any collection commission, from the defaulting party.
The Customer nominates the mobile number and email address provided at booking as the Customer's address for all notices and legal process arising from this Agreement. Service to such addresses shall be deemed valid and sufficient upon proof of transmission, whether by email, WhatsApp, or SMS.
This Agreement, together with the Booking Document, constitutes the entire agreement between the parties. No addition to, variation, novation, or cancellation shall be of any force unless reduced to writing and signed by a duly authorised representative of the Company.
No relaxation or indulgence granted by the Company to the Customer shall constitute a waiver of any right of the Company, nor shall it preclude the Company from enforcing any right that may have arisen in the past or may arise in the future.
Should any provision of this Agreement be found invalid or unenforceable, such provision shall be severed and the remaining provisions shall continue in full force and effect.
